Right of withdrawal and return policy

1. Right of withdrawal   
   1.1. A natural person has the right to withdraw from the distance contract (order made) within 14 (fourteen) days, without stating the reason.   
   1.2. The right of withdrawal shall expire after 14 days from the day the Customer (or the person designated by the Customer) has received the goods.   
   1.3. To use the right of withdrawal, the Customer must inform SIA "MAGMA", legal address Katrinas dambis 18A, Riga, LV-1045, phone number: +371 27803855 or +371 67790700, e-mail: info@emagma.lv or magma@magma.lv about the decision to withdraw from the distance contract (see the forms posted on the SIA “MAGMA” website www.emagma.lv).   
   1.4. Application for the right of withdrawal must be sent to SIA “MAGMA” before the right of withdrawal expiration date.   
    
2. Consequences of the withdrawal   
   2.1. By withdrawing from the distance contract, the Customer will be refunded by SIA "MAGMA" for all payments received from the Customer, including delivery costs, unless the Customer was offered to receive the goods at no cost at SIA “MAGMA” at Katrinas dambis 18A, Riga. The refund will be made no later than within 14 days from the date of receipt of the product by SIA "MAGMA".    
   2.2. The Customer must deliver the goods to SIA "MAGMA" at Katrinas dambis 18A, Riga as soon as possible, but no later than within 14 days from the day of withdrawal from the distance contract. It is allowed to send the goods within the mentioned term to the specified address of SIA "MAGMA".   
   2.3. The goods are inspected at the time of their acceptance, and the visual damage of the product and inconsistencies in the contents of the package are recorded. In case of damage or non-compliance of the product with the visual condition and package contents, a statement of the establishment will be drawn up, a copy of which will be handed to the Customer.   
   2.4. During the period of exercising the right of withdrawal, the Customer has the right to use the product as much as needed to verify the nature, properties and performance of the product (same way as before the purchase in a regular offline store). By exercising the right of withdrawal, the Customer is responsible for the use of the product beyond what is intended to test the nature, properties and performance of the product. The Customer is responsible for the use of the product during the period of exercising the right of withdrawal, which is incompatible with the principle of good faith, as well as for the reduction of value, quality and safety of the product.   
   2.5. The Customer must cover the direct costs of returning the goods if any. The maximum cost could be around € 20. These include not only the delivery of goods to SIA "MAGMA" but also damaged original packaging repayment.   
   2.6. The Customer may exercise the right of withdrawal and unilaterally withdraw from the concluded distance contract within 14 days (except for the cases specified in Clause 3), covering:   
   2.6.1. the expenses for the delivery of goods, that is not the cheapest standard delivery method offered by SIA "MAGMA";   
   2.6.2. the direct costs of returning the goods, except in cases when SIA "MAGMA" has agreed to cover these costs or has not informed the Customer that such costs have been incurred.   
    
3. Customer cannot exercise the right of withdrawal   
   3.1. In the cases specified in Paragraph 22 of Cabinet Regulation No. 255 of 20 May 2014 “Regulations regarding Distance Contracts”, including if:   
   3.1.1. the Customer is a legal entity;   
   3.1.2. the goods are made according to the Customer's instructions or are personalized;   
   3.1.3. the product expires soon (if it was known at the time of purchase);   
   3.1.4. the product, due to its properties, has been permanently mixed with other objects after delivery;   
   3.1.5. the Customer has requested the Seller to perform urgent repair or maintenance. However, the right of withdrawal applies to replaced goods if they are different from the changed/repaired ones.   
   3.2. The withdrawal application can be filled in Latvian, Russian or English language. SIA "MAGMA" official website emagma.lv includes forms for the exercise of the right of withdrawal.   
   3.3. SIA "MAGMA" informs that upon discovering a loss in value of the returned goods, SIA "MAGMA" may apply to the court with a claim to cover the damages caused to SIA "MAGMA" as a result of the Customer's actions.
