1. General terms of use of the emagma.lv website
1.1. Before using the website www.emagma.lv of SIA “MAGMA” (registration No.40003284410, address - Katrīnas dambis 18A, Riga, LV-1045), please carefully read these Terms of Use (hereinafter - the Terms) and the Privacy Policy. The website emagma.lv is the website created by SIA “MAGMA”, the internet address of which is www.emagma.lv, with all the information and materials contained therein.
1.2. By visiting the website www.emagma.lv or using the information about goods and services placed on the website www.emagma.lv, you personally or the legal entity you represent, if acting on its behalf, agree to these Terms. By performing activities on the website www.emagma.lv, it is considered that you have read the Terms of Use and Privacy Policy.
1.3. Without agreeing to these Terms or the Privacy Policy, further use of the website www.emagma.lv is not possible.
1.4. SIA “MAGMA” has the right to unilaterally change the content of emagma.lv, as well as the Terms of Use or the Privacy Policy at any time. Such changes take effect after their publication on the website www.emagma.lv.
1.5. SIA “MAGMA” has the right to change the prices indicated on the website emagma.lv and/or create new paid services at any time.
1.6. The images of the products viewed in the online store www.emagma.lv may slightly differ from the offered product. 1.7. The user registered on the website www.emagma.lv is obliged not to reveal his access data to other persons. If operations with the profile of a registered user are performed on the website emagma.lv (incl. goods and/or service orders) using the registered profile, it is considered that the operations in the particular profile have been performed by the registered user himself.
1.8. In case of uncertainties on filling document forms posted on the www.emagma.lv website, please contact SIA “MAGMA” electronically or by phone.
1.9. To correct input errors made during the order, it is necessary to contact SIA “MAGMA” by phone (+371 27803855 or +371 67790700) or send an e-mail: eveikals@magma.lv.
2. Using emagma.lv provided services
2.1. Misuse or abusive usage of information posted on the emagma.lv website is not allowed, incl. information republishing or usage for commercial purposes, unless the written permission of SIA “MAGMA” has been received. SIA “MAGMA” is authorized to interrupt or terminate the provision of services if Terms of Use compliance is not ensured during the order.
2.2. Requesting a person represented in or on behalf of SIA “MAGMA” to make changes to a registered order that is not completed, the application must be send by an e-mail to eveikals@magma.lv or SIA “MAGMA” contacted by calling: +371 27803855 or +371 67790700.
2.3. SIA “MAGMA” detecting errors and/or inaccuracies in the prices or descriptions of the products on www.emagma.lv website, has the right to unilaterally cancel the distance agreement if the payment of the specific product has not been made. As an exception, the distance agreement can be cancelled when ordered product is not available; due to excessive loss suffered by one or the other party; late payment of the goods and in other cases specified in the corresponding regulations.
3. Usage and confidentiality of data entered on the emagma.lv website
3.1. You should first read the Privacy Policy regarding the use of general data.
3.2. SIA “MAGMA” informs that by entering your e-mail address, you agree that your e-mail is included in the database and can be used for notifications/reminders about incomplete orders on www.emagma.lv website.
3.3. SIA “MAGMA” is also allowed to send information about news, promotions and discounts on emagma.lv and SIA “MAGMA” or SIA “MAGMA” cooperation partners if the corresponding permission was received. You have the right to unsubscribe from receiving any news by unsubscribing, clicking on the e-mail link or sending information to e-mail: magma@magma.lv or eveikals@magma.lv.
4. Privacy and copyright protection of the emagma.lv website
4.1. By ordering the product, you agree that the data entered on emagma.lv website can be used by SIA “MAGMA” in accordance with the above-mentioned Terms of Use and the Privacy Policy.
4.2. By ordering the product, you confirm that you have read and agree to the terms of delivery.
4.3. By ordering the product, you confirm that you have read and agree to the warranty and return policy.
4.4. By ordering the product, you confirm that you have read and agree to the leasing options and conditions.
5. On Terms of Use of emagma.lv website
5.1. Any disputes arising out of or in connection with these Terms or services will be settled in accordance with the procedures outlined in the laws and regulations of the Republic of Latvia.
5.2. Submit a complaint about the availability or quality of the products by sending it to the following e-mail address: eveikals@magma.lv or submit a complaint in writing by sending it to the following address: Riga, Katrinas dambis 18A, LV-1045. The complaint will be examined within 30 days from the date of receipt of the complaint, sending a reply to the contact address indicated in the complaint. If the submitted complaint is found to be unfounded and you do not agree to the acknowledgment of the complaint, you have the right to use the alternative dispute resolution options specified in regulations and laws of the Republic of Latvia by submitting a written application to the Seller for out-of-court dispute resolution, indicating:
5.2.1. name, surname, contact information;
5.2.2. the date of submission;
5.2.3. the nature of the dispute, the claim and your arguments.
5.3. All intellectual property rights in relation to the website www.emagma.lv belong exclusively to SIA “MAGMA” In case of violation of these rights, the guilty person shall be held liable in accordance with regulatory enactments, as well as shall be fully responsible for any damage that is or could be caused to SIA “MAGMA” and third parties.

6. Documents confirming the goods purchased on emagma.lv website
6.1. In case when the Customer pays and receives the order at SIA “MAGMA” point of sale, the following documents confirming the purchase of the product are issued:
6.1.1. till receipt or invoice;
6.1.2. warranty card (if required).
6.2. In cases when the ordered product is delivered to the address specified by the Customer, the document confirming the purchase is the invoice.
6.3. The authorized person of SIA “MAGMA” is indicated on the invoice, whose name and surname are equivalent to the signature of the said person, and the document is valid without a signature.
6.4. SIA “MAGMA” does not store copies of distance agreements made in the online store.
6.5. The fact that the Customer has received the product is confirmed by:
6.5.1. Customer's signature on the document (upon receipt of the ordered product in the office of SIA “MAGMA”);
6.5.2. Customer's signature on the courier electronic terminal (upon receipt of the ordered product with courier delivery);
6.5.3. entered Customer's code at the parcel terminal (upon receipt at the parcel terminal).
6.6. Claims that the order has not been delivered after the receipt of the order has been confirmed by one of the methods described in the previous paragraph shall not be accepted.
7. Warranty of goods purchased on the emagma.lv website
7.1. All goods purchased from emagma.lv have a manufacturer's warranty.
7.2. Information about the manufacturer's warranty period for each specific product can be found in the product description or can be ask to the customer consultant of SIA “MAGMA”.
7.3. The right to file a claim is valid if the product was used only in the intended conditions. For legal entities other than the Consumer, only the warranty period specified by the Manufacturer is provided.
7.4. The terms of the manufacturer's warranty are valid if the Customer can submit:
7.4.1. a document confirming the purchase (check, invoice);
7.4.2. the manufacturer's or distributor's warranty card (if included in the package).
7.5. The terms of the manufacturer's warranty do not apply if damage was caused by the fault of the Customer or user, including:
7.5.1. the product has damage to warranty seals, serial numbers;
7.5.2. the product has not been used for its intended purposes and has not been operated as specified in the instructions of the product;
7.5.3. scratched, broken structures product, maintained incorrectly or has any traces that indicate incorrect usage of the product;
7.5.4. if the damage is caused by rapid temperature fluctuations, as well as other domestic and external factors, such as soot, smoke, dust, humidity, shocks, scratches;
7.5.5. if the product has traces of unqualified repairs;
7.5.6. in cases of natural wear of elements;
7.5.7. if non-standard accessories and spare parts have been used for the product and if it has caused damage to the product;
7.5.8. if the product has been used by the Customer for production or professional purposes (in case the specific product is not intended for such purposes);
7.5.9. the warranty does not work if the damage has occurred as a result of incorrect transportation or installation of the product.
7.6. In case the product is damaged, the Customer has the following options:
7.6.1. go to the service center indicated in the manufacturer's or distributor's warranty card (taking the document confirming the purchase and the warranty card with you);
7.6.2. go to the SIA “MAGMA” office in Riga, Katrinas dambis 18A, on business days from 9.00 to 19.00 (taking the document confirming the purchase and a warranty card with you);
